How to Get a Divorce in Malaysia
There are two ways to divorce in Malaysia for non-Muslims. If both husband and wife agree to the divorce and all its terms, you can file a joint petition, which generally takes less than 6 months. If there is no agreement, one party files a single petition, which requires attending marriage counselling with the Jabatan Pendaftaran Negara (JPN) first and generally takes 6 to 12 months. In both cases, the court grants a decree nisi that becomes final 3 months later.

Frequently Asked Questions About Divorce in Malaysia
Q: Can I file for divorce in Malaysia?
A: You can file for divorce in Malaysia if your marriage is registered under the Law Reform (Marriage and Divorce) Act 1976 or is a valid monogamous foreign marriage, and both parties are domiciled in Malaysia. Generally you must also have been married for at least 2 years, although the court may allow exceptions in cases of exceptional hardship.
Q: How long does a divorce take in Malaysia?
A: A joint petition generally takes less than 6 months, and straightforward cases can finish in about a month. A single petition generally takes 6 to 12 months, or longer if contested. The divorce becomes final 3 months after the court grants the decree nisi.
Q: How much does a divorce cost in Malaysia?
A: The cost depends on whether it is a joint or single petition and how complex the case is. A joint petition is significantly cheaper because it involves less court work. TYH & Co. quotes a fixed fee upfront with no hidden charges, and instalment plans are available. Message us on WhatsApp for a free quote based on your situation.
Q: Do I need to attend marriage counselling before filing for divorce?
A: For a single petition, yes. The law requires you to attend marriage counselling with the Jabatan Pendaftaran Negara (JPN) before filing, except in limited circumstances. A joint petition does not require JPN counselling.
Q: Do I need a lawyer to divorce in Malaysia?
A: The law does not force you to appoint a lawyer, but divorce petitions must meet strict document and filing requirements in the High Court, and mistakes cause delays or rejection. In practice, almost all divorce petitions in Malaysia are prepared and filed by a lawyer.
Q: Can you handle my divorce if I live outside KL and Selangor, or overseas?
A: Yes. We handle non-Muslim divorce cases across Malaysia, and consultations, document preparation and updates are done through WhatsApp and email. Many of our clients are based overseas.
