Understanding your divorce pathway in Malaysia

For non-Muslims, a divorce in Malaysia follows one of two pathways. Knowing which one applies to you makes everything else simpler.

Mutual divorce (joint petition)

This is when both spouses agree to divorce and on the terms.

  • Faster and more affordable
  • No marriage counselling at the JPN
  • No need to prove any ground
  • Usually completed in around 3 to 4 months

Non-mutual divorce (single petition)

This is filed by one spouse, usually when there is disagreement.

  • Attend 3 marriage counselling sessions at the JPN first (KC28 or KC29), unless exempt
  • You must establish a ground for divorce
  • Usually takes around 6 to 9 months
  • We protect your interests on custody, maintenance and assets

Frequently asked questions

How does this divorce assessment work?

The assessment asks 5 short questions about your marriage and situation. It then shows the likely divorce pathway for you, whether a mutual or non-mutual divorce, and what to do next. You can then message our divorce lawyer in Malaysia on WhatsApp for advice and a quote.

What is the difference between a mutual and a non-mutual divorce in Malaysia?

A mutual divorce (joint petition) is when both spouses agree to divorce and on the terms. It is faster and more affordable and does not require JPN marriage counselling. A non-mutual divorce (single petition) is filed by one spouse, requires JPN counselling first unless exempt, and you must prove a ground for divorce.

How long does a divorce take in Malaysia?

A mutual divorce usually takes around 3 to 4 months. A non-mutual divorce usually takes around 6 to 9 months, depending on the issues involved such as custody, maintenance and assets.

Do I need to attend marriage counselling at the JPN?

For a non-mutual divorce (single petition) you must attend 3 counselling sessions at the JPN and obtain a KC28 or KC29 document before filing, unless you qualify for an exemption. A mutual divorce does not require this.

Can I file for divorce if I have been married less than 2 years?

Generally you must be married for 2 years or more before you can file for divorce in Malaysia. To divorce within 2 years, you will need to show hardship or special circumstances.
