Types of Divorce in Malaysia
Essentially, there are 2 types of divorce procedures in Malaysia.
- Firstly, it is joint petition for divorce (or mutually agreed divorce) where both parties agreed to divorce and all the terms are agreed upon. This is relatively simpler and most affordable option to get a divorce in Malaysia.
- Secondly, it is single petition for divorce (or unilateral divorce) where no agreement to divorce or no agreement on any of the terms could be reached. In this case, the party who wishes to divorce may start a single petition divorce for the other party to answer the petition (or not). This is a costlier option since there is a need to undergo longer legal process in the Court.

Process of Divorce in Malaysia

In a joint petition for divorce:
- Our divorce lawyer will assist to prepare the divorce petition on the agreed divorce terms
- Parties will sign the divorce petition
- Our divorce lawyer will file the divorce petition to the Court
- Parties are required to attend the Court hearing (1 time only usually)
- Once the divorce is allowed, parties will have to wait 3 months until the divorce certificate is issued (may be shorten with good and valid reason)
In a single petition for divorce:
- Parties must undergo counselling sessions with the JPN first before one can file a single petition for divorce in Malaysia
- Either party may file a single petition for divorce to the Court once the counselling session with the JPN is completed
- The Court will proceed to arrange case management dates in order to allow parties to appoint a lawyer and respond to the petition accordingly
- Consent of the other party is not required in a single petition for divorce as long as it is proven that the marriage has irretrievably broken down and that the other party received the single petition for divorce
- The Court will then fix for date of hearing or trial accordingly to determine the issues and decide accordingly whether to allow the divorce or not before making necessary order
- Once the divorce is allowed, parties will have to wait 3 months until the divorce certificate is issued (may be shorten with good and valid reason)
